Sentencing for sex crimes and Washington’s two strikes rule
The Washington State Legislature has raised the stakes substantially for persons convicted of sex offenses.
Washington State has a strict two-strike law. If you are convicted on two separate occasions of certain sex felonies, you can be sentenced to life imprisonment.
Washington State has indeterminate sentencing for certain major sex offenses. After serving the sentence imposed by a judge, the Indeterminate Sentence Review board will hold a hearing to determine if you can be released. You could spend the rest of you life in prison, despite the fact that a judge only sentenced you for a few years.
For certain crimes you could be on Community Custody (Parole/Probation) for the rest of your life. For any sexual felony, you can be placed on Community Custody for a minimum of 36 months.
Furthermore, there is a 25-year minimum sentence for major offenses, such as first and second-degree rape of a child and first-degree child molestation, if the state makes the special allegation that the offense was predatory.
State law also mandates a 25-year minimum prison sentence when the victim is younger than 15 years old in cases of:
- First- and second-degree rape
- Indecent liberties by forcible compulsion
- First-degree kidnapping with sexual motivation
The 25-year minimum jail term also applies to certain major sex crimes involving a special allegation regarding a victim who is:
- Developmentally disabled
- Mentally disordered
- A frail senior citizen
- A vulnerable adult
If convicted, you may also have to register as a sex offender for the rest of your life.
